How will the special compensation be calculated for the extension of the suspensions in May?

What the PNP (ΠΝΠ) predicts and what amounts the employees will receive.

In proportion to the days, the special financial support of the second suspension package, which lasts until the end of May, will be calculated. As clearly stated in the new PNP, whose employees are extended the suspension of employment contracts, they are entitled to financial support in proportion to the days of this extension. The amount of financial aid is not determined in the PNP but is referred to the ΚΥΑ of the Ministers of Finance and Labour. Given that in the first package, the special purpose compensation was set at 800 euros for 45 days, it is expected that in the second package, which lasts 30 days, the financial support of employees will be set, as stated in the “Κyriaki Ethnos” is an amount of  534 euros.

The full amount of 534 euros will be received by those employees who remain in suspension throughout the extension of 30 days, which ends on May 31. However, the extension of the suspension comes – as ethnos.gr wrote – with flexibility in the second support package, as:

cancellation is allowed after the first 15 days of suspension.

Temporary suspension of the suspension is allowed.

The extension does not have a specific time period for everyone as it had the first package precisely because the first 45 days do not end for everyone at the same time. Those who need to stay:

15 days of suspension in the May extension will receive – 267 euros

20 days in suspension in the May extension will receive – 356 euros

25 days of suspension in the extension of May will receive – 445 euros

Respectively, those who remain in suspension for 10 days in May are expected to be entitled to 178 euros and so on.

The possibility of extending the suspension has two conditions:

Who will get the full amount?

In May, there will be days of the first package and extended days for many employees. Therefore, the full amount of financial aid in the second support package is entitled to receive:

Employees of companies that were closed by state order and gradually open from next Monday, May 4, but are extended by their employers until May 31 and remain in suspension until May 31 (without temporary suspension or abolition)

Employees of companies that had remained open but were underperforming and were deemed to have been affected, which have been suspended by their employer, will have to receive a proportion of the financial aid if they join the extension.

For example :

The 45-day period for the first ones that were suspended on March 21, ends next Monday, May 4. As long as they are extended, it should count from Tuesday 5 May. Therefore, they are expected to be entitled to financial aid for 27 days, ie 480 euros.

Only 60% in suspension extension

According to the ΠΝΠ and as previously announced, employers who are affected by KAΔ and have suspended the employment contracts of part or all of their employees, may extend the suspension by up to 60% of the contracts that have already been suspended, to the maximum. 30 days and not more than 31 May. Attention, as in case of exceeding the above percentage, the employer himself pays the salaries of the employees that exceed 60%.

In other words, according to experts, a limit is imposed on companies that open gradually from Monday, in order to restore at least 40% of their employees to active employment. They can extend the suspension for the remaining 60% until May 31. The same applies to those who remained open in the first phase of the pandemic and were considered affected by ΚΑΔ, as they can extend the suspensions until 31/5 for up to 60% of those who are suspended.

For companies for which the “lock” continues with a public order and in May, the suspension of workers’ employment contracts is automatically extended for as long as the suspension is maintained.

The extension of the suspension has two conditions:

For example

Optometrists store with 10 suspended workers. It may reopen tomorrow. It can keep the 6 employees suspended until May 31st. For May, employees who remain in suspension will receive € 534 in special compensation. From June 1, all contracts will be stopped.

In June, the suspension of contracts with financial support from the state only for businesses, whose suspension will continue in May by order of a public authority, will have a potential effect (depending on the KYΔ to which it refers an authorizing provision).

As Mr. Karouzos points out, the question for labour experts is whether the maintenance clause of the same type of employment contract occupies all the staff of the company that makes use of the suspension extension or only the employees who enter into the extension measure.

Cancellation of your suspension.

The new ΠΝΠ provides for the possibility of employers to abolish the suspension of their employees under certain conditions. It is provided in detail that the companies that have suspended the employment contracts of part or all of their employees can revoke the suspension with 2 conditions:

the revocation must concern at least 40% of the employees whose contracts are suspended and

provided that the suspension has been maintained for a minimum of 15 days.

Be careful as cancellation means final recall. That is, the contracts of the employees whose suspension is revoked cannot be suspended again. Employees are also eligible for financial support in proportion to the days of suspension.

For example :

Sportswear store with 5 employees. It will reopen next Monday, May 4. It declares an extension of suspension for the 3 employees until May 31st. On May 15, he makes a final recall as he needs the 3 employees back to work. Employees will receive special compensation of 267 euros for the first 15 days of May from the state. From May 15 onwards, they must receive a salary from their employer.

The final revocation is of course not allowed for businesses – employers for which the suspension of operation continues by order of the public authority in May.

Temporary recall – termination

It is also allowed to temporarily suspend the suspension of contracts for emergency, urgent, non-deferred and inelastic needs in companies, whose activity has either been suspended by order of a public authority or is significantly affected, according to KAΔ. During the period of temporary suspension of the suspension of the employment contract, the employer is obliged to pay the employees’ salaries. That is, the employer owes the contractual remuneration in proportion to the number of working days in the “suspension period”. After the expiration of the temporary suspension of the suspension of the employment contract, the suspension of the contract continues until the completion of its full-time period.

For example :

Company reopening on Monday with 10 employees. It extends the suspension for the 6th to the end of May and restores them to active employment 4. Employees – employers, whose operation was suspended by public order or who were significantly affected, based on the relevant ministerial decisions, adjust the working hours of their employees with their operating hours. The above adjustment of the working hours of the employees is carried out on the condition that the type of employment contract of these employees is not changed.
