Environment:- What is changing in forest and cultivation areas

The bill submitted in Parliament for discussion titled “ Modern Environmental legislation” attempts to make changes among others in the following sections, as written by Niko Hilaka, a foresty and environmental expert.

  • Simplification of Environment Licensing,
  • RES Licensing Procedure
  • Protected Areas
  • Management Areas within Protected Areas
  • Forest Map settings
  • Residential densities

 

The chapter on environmental licensing attempts to reduce the time of licensing and introduces the training by the RIS of a list of private evaluators of Environmental Impact Studies

The energy chapter attempts to reduce time and simplify the licensing of RES projects

 

For environmental law, which also deals with the issue of protected area management bodies, an institutional change is being attempted, with the establishment of a Natural Environment and Climate Change Organisation, which will include the management body of protected areas, through a new administrative framework. This will include a five- member administration or the organisation, a general directorate and two addresses (geographically designation of Northern and Southern Greece, which will include the respective protected areas.

The amendments to the Land Use Decree essentially define the zones that can be proposed by the Special Environment Studies of Natura areas and the permitted land use per zone, from which the special Environment Study can be selected.

In the chapter of forest maps and forest legislation, interventions are attempted in tow main areas. 1) In the currently cultivated areas and in the areas that are currently used for residential use. 2) With the existing legal framework are called residential densities, the regulations of which were judged by the CoE as unconstitutional

 

The following agreements are provided for agriculturally cultivates areas:-

The first concerns the areas that have lost their forest character before 11/06/1975, the voting date of the Constitution. Due to interventions based on a relevant administrative act, which is covered by the presumption of legality, forest or grassland areas are not classified as forests and are not declared reforestable, as long as they maintain the use assigned to them.

Administrative acts are considered acts issued within the framework of agricultural legislation, such as decisions of expropriation committees or for all the areas of which they were taken (plots of land, excluded landowners, properties available and common areas for total lands) or distribution and reforestation. This refers to the relevant cadastral diagrams, as well as permits of the minister-prefect for each case of transfer of agricultural real estate.

Based on this regulation, all areas that fall into these categories are not characterised as forests, woodlands or grasslands

The second regulation concerns obligation of the administration to proceed with the reform of the forest map within two months, which in addition to the above mentioned areas, the digital files of the datea AGROSI SA, which had come to OEK must be included without requiring revision, processing or completion.

 

Until complete ion of the redevelopment of the forest map, the validity of the forest maps is suspended retroactively, with regards to the plots of land included in the Integrated System with the digital archives of OPEKEPE

With this second regulation, in essence, the validity of the forest maps for these plots included in the OS of OPEKEPE is suspended retroactively, so the characterisations as forests until the reform of the forest map do not apply. Consequently, the retroactive effect creates the conditions for claiming the payment of the royalties on these areas.
