The electronic and ‘without paperwork’ completion of real estate transactions brings a revolution on property transfers, as well as property transferred through donation, parental donation or inheritance.
The ministry of finance presented the relevant application to notaries on 14th March, which will be implemented in the coming months.
The planning of the Finance Ministry and the AADE foresees implementation by May. The new system will provide enormous ease to taxpayers, as it simplifies a complicated procedure which applies today and constitutes a brake in the development of real estate.
However, the new system will lead to increased and more effective checks on transfers, both in terms of the legitimacy of the transaction and the origin of the money spent.
The tax authorities have strong indications that money laundering takes place through real estate transfers, from rings using foreigners as “front-men”.
Notaries have been informed
In the morning of 14th March, the Coordinating Committee Notarial Associations of Greece met with officials from the finance ministry for the first demonstration of the electronic programme submitting transfer tax declarations.
The notaries were presented the application, while the Association of Courts of Appeal notaries of Athens – Piraeus – Aegean & Dodecanese, organised the following Monday, an information event, where the new application for the electronic transmission of tax returns, transfer of inheritances, donations and parental donations, was presented to the notaries.
With a “click”
The ambition of the new system is for the transfers of real estate, for any reason, to be completed from the offices of notaries with a “click” and without paperwork.
For this purpose, the offices of notaries will be certified in the AADE, thus obtaining the authorization to conduct property transfers electronically.
Transfer declarations will now be submitted only via TAXISnet and the relevant transfer taxes, donations – parental donations, inheritances will be calculated and will be automatically cleared. With the issue of the determination of tax act, i.e. clearing notes, on which will appear the code numbers of the identity of the liabilities.
Gains and losses
The new system will make it much easier for those who want to make real estate transactions.
For example, a taxpayer who lives in Athens and wants to transfer a property located in Rhodes, he will not need to travel to Rhodes, but the whole process will be completed by a notary of Athens. The opposite will be valid, of course.
At the same time, the properties transferred electronically will not need to be declared in E9. As the transfer will be done electronically and will be registered automatically in taxisnet, it will pass through the taxpayers share
in taxisnet and his property status will be updated.
As far as checks are concerned, they become more effective. With the current regime, a check of the transfer of a property requires the study of bulky folders, stacked in the cupboards of the Ephorates.
Note that the operational plan of the AADE for 2019 more than 3,000 checks in real estate transfers are foreseen, which however encounter bureaucratic difficulties.
Thorough checks are usually done only in cases of complaints or in cases of taxpayers, that the tax-auditors or prosecuting authorities or financial police characterise suspicious.
