The Zakynthos Lawyer’s Association takes a position on the recent sad incident of femicide on our island, with a written report to the Prosecutor of the Supreme Court, the Minister of Citizen Protection, the Plenary of Presidents of Lawyer’s Associations of Greece, the Appeals Prosecutor of Patras and the Misdemeanor Prosecutor of Zakynthos, in order, as the relevant report states, to investigate any disciplinary and criminal responsibilities of government officials, in relation to the intentional homicide that took place in Zakynthos in the early hours of August 1, 2022.

The Board of Directors of the Zakynthos Lawyers’ Association, with the minutes of its meeting No. 11/03-08-2022, unanimously decided to send the following report to the above recipients, in order to investigate any disciplinary and criminal responsibilities of state officials, in relation to the on purpose homicide that took place in Zakynthos in the early hours of August 1, 2022.
REPORT
As is known, in the morning hours of August 1, 2022, a man of Albanian origin stabbed his 49-year-old wife to death in Zakynthos, and a few hours later he was arrested, in the Keri area of ​​Zakynthos, where he went to the construction site where he works. A criminal prosecution was brought against him for the crime of intentional homicide and he is scheduled to plead guilty on Friday, August 5, before the prosecutor of Zakynthos.

 

According to the reports of the local press, the accused-murderer at 8 o’clock on Sunday evening “found himself at home and began to beat his wife mercilessly, venting his sick fury upon her. The woman in a miserable condition and after he had disappeared managed to pull herself together and cross the threshold of the police for the second time and file a lawsuit against her tormentor. Authorities were reportedly still looking for him at 10:30 p.m. when the victim returns to the ground floor of the duplex in the Tsilivi area, she finds him in front of her. According to an eyewitness, the perpetrator grabs her by the hair and drags her to the balcony, shouting at her “I will kill you”. Then, as it appears from the report, with a kitchen knife which he furiously stabbed in all parts of her body, he took her life.
From the same report it appears that the same perpetrator had been arrested in the recent past for domestic violence, after beating his wife, he was taken to the Prosecutor and released with the restrictive condition that he not approach his forty-year-old wife and the marital home, at 100 meters.

 

Relentless questions arise about the behavior of the authorities in relation to the correctness of following the automatic procedure and the measures taken to protect the victim, given that the perpetrator was already a suspect and in fact had been given strict restrictive conditions.
A) It is requested to investigate under what conditions and in what way the pursuit of the perpetrator took place after the complaint filed against him by the victim on Sunday, July 31, 2022, who came to the police mercilessly beaten.
B) If the perpetrator was sought in order to be arrested or otherwise he was notified by phone by the police pre-investigation officer, that he is being prosecuted as a result of the crime of his wife and that he had to come forward voluntarily to be arrested.
C) If this telephone notification and invitation of the perpetrator was never made by the preliminary investigation officer, then HOW was he informed that he was reported and wanted for arrest, a fact that angered him and directed him to the victim’s house, where he murdered her?

D) Since the signs of the beating were very obvious, why, as a result of the victim’s complaint, was she not referred to the Hospital of Zakynthos, with a written order and accompanied by a police officer, to carry out the required forensic report. This whole process would have lasted several hours (at least), the perpetrator would not have found the victim in her home and she would probably be alive today….Much more, because of the seriousness of the situation, she could be detained by the medical staff to the safety and comfort of the Hospital for health reasons and in this way would have prevented her killing which happened approximately 1 hour after the perpetrator learnt of the victim’s complaint.
E) If in view of the perpetrator’s relapse and the restrictive condition imposed on him, there was any care and all the necessary measures were taken by the authorities to protect the victim, who seems to have only returned to his home, where the perpetrator was waiting for her to kill her.
The Zakynthos Layers’ Association, repeatedly in the past, has reported in writing to all the competent authorities for the improper observance of the terms of the automatic procedure in Zakynthos.
It is recalled that on 5-7-2021, a report of the Lawyers’ Association was sent to the Prosecutor of the Supreme Court for the non-observance of the automatic procedure, in very serious environmental crimes, and to this day, the automatic procedure for the crimes is still not observed of article 28 of Law 1650/1986.
The authorities to whom this report is being notified are requested to show elementary sensitivity and to prevent the prevalence of lawlessness on the island of Zakynthos.
