The accused for the murder of Bacary Henderson were found guilty again.
According to pelop.gr,
Five defendants were found guilty of intended fatal bodily harm, and one was found guilty of fatal bodily harm. In terms of sentencing, one received a ten-year sentence, four received eight years each, and the sixth one received a five-year sentence. All sentences were reduced from the previous trial except for the accused given the ten year sentence.
This is the verdict of the Mixed Jury Court of Patras regarding the trial for the murder of the American Bacary Henderson in Laganas, Zakynthos.
It is noted that the specific decision is the same as the first trial, but it was taken by a majority in contrast to the first instance which was unanimous. Those who voted in the minority were the President, a judge and a juror, who supported the prosecutor’s proposal for intentional homicide with possible deceit.
It should be mentioned that the family of the unfortunate Bacary Henderson, demanded that the accusation be intentional homicide. At the last court hearing, the prosecutor had proposed the guilt of all for intentional homicide together with possible deceit for all six defendants.
Regarding the mitigating factors, the prosecutor suggested only for the accused who is still being held to accept the mitigating factor of his later good behavior. The court accepted the request by a majority only the request for the first accused and today the only detainee for the mitigation of his subsequent good behavior. The president, a judge and a juror voted again.
Another note in regards to the accused is the only detainee to date sentenced to 8 years in prison is preparing to submit a request for parole, which will be considered in the coming days by a judicial council and will probably be accepted.
Bacary Henderson’s family remained silent in the room when they heard the decision, but showed the feeling of frustration they feel as they try to work out what the decision means.
The fateful night in Laganas
It is recalled that in the early hours of July 7, 2017, Henderson and his friends were having fun in a bar in Lagana, Zakynthos, when a fierce quarrel broke out over a selfie photo with a waitress, with Serbian patrons initially verbally attacking the group of Americans.
The fight that started inside the bar, led to a chase and the savage beating until the death of the young man by at least 9 people. The video with the murderous blows to the body and head of Bakari on a main street of Laganas that saw the light made the rounds of the world shocking relatives and friends of the unfortunate young man. The unfortunate Bakari was running to escape from his pursuers but a strong kick to the side threw him in the back of a parked car and he immediately fell to the ground.
